Failure to pay your infringement within 28 days may incur additional costs or further enforcement action.

  • By mail with a cheque made out to Colac Otway Shire Council, PO Box 283, Colac, 3250

Overdue infringements

If you have received an infringement and it remains unpaid 28 days after the date of issue, you may incur additional costs.

The steps taken to ensure the payment of overdue infringements are as follows:

Step 1: Penalty reminder notice

If an infringement is unpaid and overdue then a penalty reminder notice will be issued after 28 days. An additional charge will be added. Options available to you include:

  • Pay the total amount by the due date
  • Request an internal review of the infringement
  • Nominate the person responsible for the vehicle at the time of the alleged offence
  • Request to have the matter determined in the Magistrates’ Court.

Step 2: Infringement may be referred to Fines Victoria or the Magistrates' Court

If you do not respond to the penalty reminder notice within 28 days, the infringement notice may be sent to Fines Victoria or the Magistrates' Court.

Statutory costs

Additional costs, as outlined above, are reviewed and increased by the state government regularly.

Payment Plans

You may apply for a payment plan to pay this notice under Section 46 of the Infringements Act 2006 or a payment arrangement under Part 5 of the Fines Reform Act 2014. The application must be in writing and made before the infringement is lodged with Fines Victoria for collection. Note: payment plans can be applied for or will be offered for a period up to six months in length.
