C102cola - Open Space Contributions Amendment
The Colac Otway Shire has prepared Amendment C102cola to the Colac Otway Planning Scheme. Amendment C102cola proposes to amend the wording of the Schedule to Clause 53.01 of the Colac Otway Planning Scheme by removing the word ‘additional’ from Table 1 ‘Subdivision – creating 3 to 5 additional lots’, ‘Subdivision – creating 6 additional lots or more’ and ‘Subdivision
creating – 3 additional lots or more’, to allow for the collection of open space contributions for a three or more lot subdivision in the Shire.
The Amendment applies to all land in the municipality of Colac Otway Shire.
What the amendment does
The amendment is required to correct a discrepancy in the Ordinance of the Colac Otway Planning Scheme. The Colac Otway Public Open Space Strategy 2011, which is a Reference Document of the Scheme, introduced open space contributions to the Scheme via Amendment C75. The Open Space Strategy aimed to guide Council in meeting the diverse open space needs of the community in both the short and longer term and provides the background for the open space policy position of Council.
The Colac Otway Public Open Space Strategy 2011 sought to apply a minimum 5% open space contribution for subdivisions of three lots or more, and where the number of lots exceeds five, an additional contribution of 1% per lot up to 10%. The current Schedule of Clause 53.01 does not reflect this direction, stating that a subdivision creating 3 to 5 additional lots must contribute 5%. This has the effect of not requiring a three lot subdivision to contribute to the open space system.
This amendment will ensure that the provisions of the Colac Otway Planning Scheme are consistent with the adopted Colac Otway Public Open Space Strategy 2011 and that open space contributions are collected for the betterment of the Colac Otway community.
On 26 June 2019, Council considered the amendment and resolved to request the Minister for Planning to authorise Amendment C102cola and to exhibit the Amendment. The Council report and minutes can be viewed here:
