Amendment C119cola - Erosion Management Overlay
Colac Otway Shire has prepared the Erosion Management Overlay Review 2021.
The Review seeks to streamline and simplify the current Erosion Management Overlay (EMO) in the Shire. The EMO is located primarily in the coastal, southern and central parts of the Shire. It is the key planning tool to manage the impacts of land slip within the Shire. It is applied to land prone to erosion, landslip and other land degradation processes and seeks to minimise land disturbance and restrict inappropriate development.
The Review focused on opportunities to remove areas from the current EMO mapping where the risk of landslip does not warrant such controls. The EMO mapping is proposed to be amended, removing or reducing the coverage of over 500 Shire properties from the Overlay coverage.
Amendment C119cola seeks to implement the findings of the Review.
The Amendment modifies the existing EMO Schedule to increase planning permit exemptions and minimise permit submission requirements. The revised Schedule will increase the range of works exempted from requiring a planning permit. The proposed Schedule will also decrease the requirements for geotechnical assessments in some circumstances.

- Amend Schedule 1 to Clause 44.01 Erosion Management Overlay.
- Amend the Schedule to Clause 72.04 Documents Incorporated in the Planning Scheme to insert the Requirements for a Geotechnical Assessment, Landslide Risk Assessment or Landslide Hazard Assessment prepared in support of a planning permit application under the Erosion Management Overlay (EMO) October 2021 as an Incorporated Document in the Colac Otway Planning Scheme.
- Amend the Schedule to Clause 72.08 Background Documents to insert the Colac Otway Shire Erosion Management Overlay Review September 2021 as a Background Document in the Colac Otway Planning Scheme.
