The Minister for Planning is considering whether to prepare, adopt and approve Colac Otway Planning Scheme Amendment C127cola under section 20(4) of the Planning and Environment Act 1987.

Amendment C123cola

The Director, Development Approvals and Design, under delegation from the Minister of Planning exercised powers under Section 20(4) of the Planning and Environment Act to approve Amendment C123cola to the Colac Otway Planning Scheme

What the draft amendment does

The Amendment rezoned 50 hectares of land bounded by Sinclair Street South, Irrewillipe Road, Hart Street, and Harris Road, Elliminyt from the Rural Living Zone to the General Residential Zone.

The Amendment is in line with the Colac 2050 Growth Plan (Colac Otway Shire 2019). The Colac 2050 Growth Plan establishes a strategic framework for the future planning and development of Colac.

The subject land is identified within the Deans Creek Corridor and prioritises residential development through rezoning and installation of drainage and stormwater management infrastructure. The Amendment also applies a new Schedule 8 to the Development Plan Overlay (DPO8) to ensure the development occurs in accordance with the broad development principles of the Irrewillipe Road Framework Plan and provision of essential community infrastructure.

In addition, the Amendment applies an Environmental Audit Overlay to land at 145 Harris Road, Elliminyt which has been identified through preliminary site investigations as having a ‘medium’ potential for contamination.

Specifically, the Amendment makes the following changes to the Colac Otway Planning Scheme:

  • Rezone the land from Rural Living Zone to General Residential Zone – Schedule 1 in accordance with the Colac 2050 Growth Plan;
  • Apply a Development Plan Overlay – Schedule 8 to ensure comprehensive and coordinated development;
  • Apply an Environmental Audit Overlay to 145 Harris Road, Elliminyt.

 

Priority Project Standing Advisory Committee

The decision follows a Priority Project Standing Advisory Committee hearing held on 22 and 23 June 2003 to hear from submitters to the amendment.

Amendment C111cola

The Minister for Planning has approved Amendment C111cola to the Colac Otway Planning Scheme.

The Amendment comes into operation on the date this notice is published in the Victoria Government Gazette.

The combined planning scheme Amendment and planning permit application facilitates the upgrade and expansion of the Red Rock Regional Theatre and Art Gallery in Cororooke. The Amendment rezones a 4,907 square metre portion of land at 30 Factory Road, Cororooke from Farming Zone to Township Zone. Planning permit PP219/2020-1 applies to 520 Corangamite Lake Road and 30 Factory Road, Cororooke and allows subdivision of the land into three lots, use of the land for a food and drink premises (café) and an on-premises liquor license, temporary use of the land for a store (tram storage), extensions and alterations to buildings and associated works, display of signage, alteration of access to a road in a Transport Zone 2, creation of an easement, and reduction of bicycle parking requirements.

Amendment C118cola

The Minister for Planning has approved Amendment C118cola to the Colac Otway Planning Scheme. The Amendment comes into operation on the date this notice is published in the Victoria Government Gazette (28 July 2022).

The Amendment amends the schedule to Clause 43.01 Heritage Overlay to refer to the Colac Otway Planning Scheme Heritage Control, HO305 – Murray Street Precinct Colac, Incorporated Plan 2020; amends Schedule 8 to Clause 43.02 Design and Development Overlay to change the signage category from Category 3 to Category 1; amends the schedule to Clause 72.04 Documents Incorporated in this Planning Scheme to update the Murray Street Precinct, Colac Statement of Significance and include the Colac Otway Planning Scheme Heritage Control, HO305 – Murray Street Precinct Colac, Incorporated Plan 2020; amends the schedule to Clause 72.08 Background Documents to update the Colac Otway Heritage Study Volumes 1 and 2 (Mary Sheehan & Assoc., 2003); and amends Planning Scheme Map No.11HO to remove some non-contributory properties from the fringe of the HO305 Murray Street Precinct.

Amendment C116cola

Colac Otway Shire and the Corangamite Catchment Management Authority (CCMA) have prepared the Birregurra Flood and Drainage Strategy 2021.

Council considered the Amendment and the Planning Panel Report at the Council meeting on the 29th June 2022 (meeting minutes). At this meeting Council resolved to adopt the Amendment and forward it to the Minister of Planning for approval. 

The Amendment was gazetted on the 8th September 2022 and is now finalised.

Amendment C119cola

Colac Otway Shire has prepared the Erosion Management Overlay Review 2021 and Amendment C119cola.

The Review streamlines and simplifies the current Erosion Management Overlay (EMO) in the Shire. The EMO is located primarily in the coastal, southern and central parts of the Shire.  It is the key planning tool to manage the impacts of land slip within the Shire.  It is applied to land prone to erosion, landslip and other land degradation processes and seeks to minimise land disturbance and restrict inappropriate development.

The Review focused on opportunities to remove areas from the current EMO mapping where the risk of landslip does not warrant such controls.  The EMO mapping was amended, removing or reducing the coverage of over 500 Shire properties from the Overlay coverage. 

Amendment C119cola implements the findings of the Review.

The Amendment modifies the previous EMO Schedule to increase planning permit exemptions and minimise permit submission requirements.  The revised Schedule increases the range of works exempted from requiring a planning permit.  The Schedule also decreases the requirements for geotechnical assessments in some circumstances.

Amendment C119cola was approved and gazetted on 21 September 2022.

Amendment C113cola

The Minister for Planning has approved Amendment C113cola to the Colac Otway Planning Scheme.

The Amendment rezones a surplus school site in Cressy from Public Use Zone 2 - Education to Township Zone, applies a Design and Development Overlay and amends the requirement for a public open space contribution.

The Amendment comes into operation from the 31st March 2022.

Amendment C121cola

The Minister for Planning has approved Amendment C121cola to the Colac Otway Planning Scheme.

The Amendment reintroduces heritage policy provisions which were inadvertently removed by Amendment C108cola.  The Heritage Design Guidelines for each of the twelve precincts are included as separate Incorporated Documents in the planning scheme.

The Amendment comes into operation from the 18th March 2022.

Amendment C090cola

The Minister for Planning has approved Amendment C090cola to the Colac Otway Planning Scheme.

The Amendment implements the findings of the Deans Creek and Barongarook Creek Flood Study (2017) through changes to the Floodway Overlay (FO) and the Land Subject to Inundation Overlay (LSIO) maps and schedules to improve the performance of the Colac Otway Planning Scheme in responding to flood events in Colac and surrounds.   

The amendment comes into operation from the 30th July 2021.

Amendment C109cola

The Minister for Planning has approved Amendment C109cola to the Colac Otway Planning Scheme.

The Amendment applies the Specific Controls Overlay to the land at 10 Drapers Road, Colac East and inserts a new incorporated document titled ‘Colac East Service Station Advertising Signage, 10 Drapers Road, Colac East, December 2020’ to allow the installation and display of signage associated with a service station. 

The amendment comes into operation from the 22nd July 2021.

Amendment C97 - Colac 2050 Growth Plan

Amendment C97 was an amendment to the Colac Otway Planning Scheme which proposed to implement the key land use planning directions of the Colac 2050 Growth Plan by updating planning policy. It also proposed to replace the current Colac Framework Plan with the Colac 2050 Framework Plan. This updated Plan identifies a revised urban boundary, which will contain development within a defined area. It also sought to improve the overall urban structure, connectivity and walkability of the town.

The Minister has now approved C97cola.  The Amendment was gazetted on 7th December 2020 and is now complete.

Amendment C101cola- Environmental Significance Overlay - ESO Schedules

The Colac Otway Shire has prepared Amendment C101cola to the Colac Otway Planning Scheme.  Land affected - Amendment C101cola applies to all land covered by the Environmental Significance Overlay Schedule 1 (ESO1) in Colac Otway Shire and land covered by Schedule 2 (ESO2) in and around Colac township.

The Minister has now approved C1010cola.  The Amendment was gazetted on 12th November 2020 and is now complete.

Amendment C108cola

The Colac Otway Shire has prepared Amendment C108cola to the Colac Otway Planning Scheme.  Amendment C108cola replaces the Local Planning Policy Framework of the Colac Otway Planning Scheme with a new Municipal Planning Strategy at Clause 02, local policies within the Planning Policy Framework at Clauses 11-19 and a selected number of local schedules to overlays and operational provisions consistent with changes to the Victoria Planning Provisions introduced by Amendment VC148.

The Minister has now approved C108cola.  Amendment was gazetted on 30th July 2020 and is now complete.

Amendment C103cola - Anomalies Amendment

The Colac Otway Shire has prepared Amendment C103cola to the Colac Otway Planning Scheme.  Amendment C103cola proposes to corrects mapping and ordinance anomalies, errors and redundant provisions of the Scheme. 

The Minister has now approved c103cola.  Amendment was gazetted on 9th July 2020 and is now complete.

Amendment C102cola

The Colac Otway Shire prepared Amendment C102cola to the Colac Otway Planning Scheme.  Amendment C102cola amended the wording of the Schedule to Clause 53.01 of the Colac Otway Planning Scheme by removing the word ‘additional’ from Table 1 ‘Subdivision – creating 3 to 5 additional lots’, ‘Subdivision – creating 6 additional lots or more’ and ‘Subdivision
creating – 3 additional lots or more’, to allow for the collection of open space contributions for a three or more lot subdivision in the Shire.

The Minister for Planning has now approved Amendment C102cola.  The Amendment was finalised on 27th March 2020 and now is complete.

Combined Amendment C104cola and PP189/2019-1

The combined amendment proposed to apply the Specific Control Overlay to 265-281 Murray Street, Colac to facilitate the development of the former Mitre 10 building on Murray Street for the purpose of a whiskey distillery.

Council considered the combined amendment on 26th February 2020, when it resolved to adopt the combined amendment and forwarded to the Minister for Planning Approval.

The Minister has approved C104cola and PP189/2019-1.  The combined amendment was gazetted on 14th May 2020 and is now completed.
